Oversize Cargo Accidents

Oversize cargo refers to loads that are higher or wider than what will fit in standard containers but are still able to be transported on top, open-side, open-top or flat-rack containers. Oversize loads are also sometimes called over-dimensional loads. Listed below are some examples of oversize cargo:

  • Machinery
  • Construction materials
  • Metal coils
  • Construction pipes
  • Houses

Oversize Cargo Accidents

It can be very difficult for truckers to transport oversize cargo; it is not uncommon for large trucks carrying this type of cargo to be involved in collisions. If you or a family member has sustained an injury in a truck crash that was caused by oversize cargo, you may have grounds for legal action. Contact a truck accident lawyer at Jonathan Perkins Injury Lawyers to explore your legal options.

What Are Some Oversize Cargo Regulations?

There are federal and state regulations that state the maximum height and weight for cargo shipped on tractor-trailers and other large trucks. Truck drivers who are transporting cargo over 80,000 pounds in Connecticut must receive a special permit from the Department of Transportation.

As for the height restrictions, the legal limit for transporting oversize cargo is thirteen feet and six inches. Trucking companies that wish to transport loads over this height will need a special permit. The height requirements vary from state to state due to the different clearances in various states, which allow the cargo to safely pass underneath bridges and tunnels. If the cargo exceeds these measurements, a truck driver will need a special permit with a route stating the bridges and tunnels that need to be avoided. In addition, if the load is over eight feet and six inches wide, a permit will be required. Just like the height requirements, the maximum width requirement is different in every state.

Over-dimensional loads are usually transported by a truck with a trailer. The requirements for interstate cargo trailers, including the interstate victory series, interstate load runner trailers and the interstate Pro series trailers, vary by location. Depending on the trailer’s size, Connecticut may require a pilot or escort car to follow in front or behind the trailer. The escort or pilot car is used to alert the truck driver in addition to the other motorists that they encounter on the highways.

If a truck driver or a trucking company violates these cargo regulations, they may be held liable for any damages that occur in a truck crash. Our experienced lawyers may use weigh station records, trucking company logs and records of what was shipped to prove that a truck was overweight or overloaded at the time of the collision.
